FELONY:
A felony is a crime for which the potential punishment carries a greater than one year in the county jail.  If you are charged with a felony, the first importance step in the process is a Preliminary Examination.  At the Preliminary Examination, the prosecutor will show probable cause that a crime was committed and probable cause that you were the person who committed the crime.  If the prosecutor fails to meet this burden of proof, your case will be dismissed by the judge.  Having a felony on your record can have a devastating effect upon employment, school and custody of a child. 

MISDEMEANOR:
A misdemeanor is crime for which the maximum punishment is up to one year in the county jail.  Most misdemeanors carry a possible punishment of 93 days in the county jail.  With a misdemeanor charge, there is no preliminary examination.  Your case will be set for a Pretrial Conference then a trial.
